NATA Applauds 2nd Circuit Ruling on East Hampton, Calls on Town to Rescind Criminal Summonses

On November 4th, the United States Court of Appeals for the Second Circuit issued a ruling in favor of the Friends of the East Hampton Airport, Inc. in its battle with the Town of East Hampton.  The 2nd Circuit concluded that local laws enacted by the Town of East Hampton limiting access to the town's airport violate the Airport Noise and Capacity Act of 1990.  The 2nd Circuit directed the lower court to issue a preliminary injunction barring the Town of East Hampton from enforcing two local laws.  The Town’s restrictions include a mandatory curfew prohibiting all aircraft from using the airport between 11 p.m. and 7 a.m., and an extended curfew prohibiting “noisy aircraft” from using the airport from 8 p.m. to 9 a.m.  A third law, imposing a weekly flight limit had already been enjoined in the lower court in 2015.  Recently, the Town issued criminal summonses imposing significant financial penalties and threatened arrest to a number of NATA Part 135 members.

“NATA is pleased the 2nd Circuit made a sound decision in favor of aviation businesses and our national airport system,” stated NATA President Martin H. Hiller. Hiller added, “The imposition of arbitrary airport restrictions that do not comply with FAA procedures would burden the vibrant general aviation community at HTO, potentially reducing future investment and creating inadvertent job loss.  In light of this important decision, we call on the Town to immediately rescind the 38 airport curfew criminal summonses it has issued related to these illegal restrictions and to refund the fines already levied on innocent general aviation operators.”  
 

 


CBP Commissioner Highlights CBP General Aviation Working Group’s Efforts In Orlando

 
On November 1st, CBP Commissioner R. Gil Kerlikowske outlined ways the agency and the general aviation community are working collaboratively to help improve “communication, establishing more uniformity from port to port, and streamlining and simplifying procedures for business aviation operators.”  To help meet these goals, and to facilitate collaboration, CBP formed the CBP General Aviation Working Group.  This joint industry-government working group is comprised of representatives from NATA, NBAA, AOPA, international service providers, and CBP personnel.

“In 2017, the General Aviation Working Group will continue working to improve efficiency and effectiveness, carrying on its important work on a CBP General Aviation Operators’ Guide to replace the obsolete Private Flyers’ Guide.  The group will also work toward improving CBP uniformity through the issuance and re-issuance of CBP memos and external guidance documents to be made available on CBP’s website,” stated Commissioner Kerlikowske. The Commissioner also touched on two pilot programs CBP is considering that would “leverage APIS.” One program addresses the Southern Border Overflight Exemption by going paperless, and the second program, a Single-Syntax APIS Solution, “would let all unscheduled private and commercial GA operators interact with CBP through a singular mechanism in APIS.” For more information on the CBP General Aviation Working Group initiatives, please contact Megan Eisenstein at meisenstein@nata.aero

National Air Transportation Foundation Accepting Scholarship Applications

 

NATA awards several scholarships throughout the year to aviation college/university program and flight training students — as well as association members looking to continue their education. The National Air Transportation Foundation (NATF) is currently accepting applications for: The Pioneers of Flight Scholarship, The Dan L. Meisinger Sr. Memorial Learn to Fly Scholarship and The NATA Business Scholarship. Multiple awards are available from $1,000 to $2,500 with application deadlines in November and December 2016. Banyan Air Service Receives Certification

 

Banyan recently received certification from Mexico’s Direccion General de Aeronautica Civil (DGAC) to perform maintenance and avionics services on Mexican-registered Beechjet, Challenger, Citation, Falcon, Hawker, HondaJet, King Air, Kodiak, Learjet, Piaggio and Pilatus airplanes. This new certification complements other FAA maintenance certifications that Banyan currently holds from Argentina, Bolivia, Brazil, Cayman Islands, Chile, Colombia, EASA, Paraguay and Venezuela. Pentastar Unveils Wireless Charging Unit

 
Last week in Orlando, FL, Pentastar Aviation introduced a new wireless charging unit for aircraft cabins. These units accept aircraft power without cords or adapters to efficiently charge mobile devices with wireless-charging capability. The wireless charging unit is produced by Cobalt Aerospace. Marathon Jet Center Sees Increase in Aircraft Traffic

 

With the opening of a new U.S. Customs and Immigration facility at Florida Keys International Airport (MTH), Marathon Jet Center has seen an increase in traffic. Since April, the FBO has seen approximately 100 international arrivals and expects business to improve more once high season begins after Thanksgiving. The company plans to enhance its facility next year with the opening of a new 12,000-sq-ft hangar and improvements to the terminal. Read more.
