|FAA Issues Revised AC On Part 139 Mandated Fire Safety Training
Last week, the FAA published an updated Advisory Circular 150/5230-4b (AC), Aircraft Fuel Storage, Handling, Training, and Dispensing on Airports. The AC provides guidance on the requirements for developing and approving the fire safety training programs that fueling agents at airports certificated under Part 139 are required to utilize.
NATA, as a leading provider of Part 139 approved fire safety training through its Safety 1st Professional Line Service Training Program (PLST) and Line Service Supervisor Training seminar, has worked closely with the FAA throughout the revision process of AC 150/5230-4b, submitting comments to the draft version in May of this year.
“We are very pleased with the FAA’s efforts in revising the AC,” said Amy Koranda, NATA director of safety and security. “By working closely with training providers such as NATA, the FAA has created an advisory circular that helps to raise the standard of safety training at our nation’s airports.”
With the release of the AC, NATA is moving forward with the approval of its new Online Supervisory training module that will include Part 139 fire safety certification. More information about this program will be available in the coming weeks.

In comments to the FAA, NATA supported efforts to expand passengers’ ability to use personal electronic devices (PEDs) on air charter flights and fractional program aircraft.
The FAA is accepting comments through October 30 on a request for comments on expanded PED use.
NATA’s comments articulate the position expressed by the NATA Air Charter Committee that improved access to PEDs, including the ability to use connected mobile devices such as cell phones and e-readers, would be welcome by the passengers on air charter and fractional program aircraft.
Members are encouraged to submit their views on the issue.

|FATA’s New Program To Highlight Importance Of GA
The Florida Aviation Trades Association (FATA) has announced its Beyond the Runway -- Why General Aviation Means Business initiative, the association’s advocacy program to get information about general aviation (GA) into the community. In a news release last week, FATA Executive Director Paula Raeburn stated, “There’s a gap in information – generally – about how GA affects everyone in a community and more specifically, there are so many misconceptions about GA – what it is and what it does for a community.”
Along with information about the industry, including its local and economic impacts, Beyond the Runway will offer presentation guidance materials that will help non-aviation businesses and communities understand the value of the industry. FATA’s magazine, “Florida Aviation Business,” highlights the program (see page 8) and how you can be a general aviation advocate to your non-aviation business partners.

|NATA Asks Indiana State Supreme Court To Review Decision That Could Damage Aviation Business
NATA has learned, through its State Advocacy Network, of an Indiana Appeals Court decision that could potentially damage aviation businesses by providing localities that do not own or operate an airport the authority to regulate land uses at airports within the localities’ jurisdiction. Long-standing practice, state laws, and federal grant assurances allow airport sponsors (usually localities that own and operate the airport) the authority to decide exclusively how airport-owned land is used. Under this decision, an airport sponsor would be required to seek permission from a local municipality prior to deciding to what type of uses airport lands could be put.
NATA believes that this decision would harm airports, aviation businesses and airport users. Often localities surrounding airports have priorities that directly conflict with those of the airport authority and the safe and efficient use of the airport within the National Airspace System. NATA has joined the Airports Council International – North America and Aircraft Owners and Pilots Association in asking the Indiana Supreme Court to review and overturn the appeals court decision.
While this is a State of Indiana issue, it does have the potential to affect aviation businesses across the country. If left standing, this decision would likely be seized upon as a model for anti-airport groups around the country to oppose airport and aviation growth, expansion and utilization.
The Indiana State Supreme Court will likely decide whether it will review this case, Town of Zionsville V. Hamilton Co. Airport Authority, in the next several months.

|NATA Safety 1st Ground Audit Workshop – November 14-15, 2012, Englewood, CO
NATA Safety 1st has established the NATA Safety 1st Ground Audit Program and the standards to create a consistent operational safety standard for fixed base operators, airports, and other service providers while increasing the overall safety level of these operations. This program also provides on-demand charter, fractional and corporate aircraft operators with an alternative to costly proprietary audits from these service providers.
NATA's Safety 1st Ground Audit Standard will allow for two levels of certification: a self-certification level and a third-party audit level. All candidates must submit an application to become an auditor and, if qualifications are met, they then need to be trained on the Ground Audit Standard by NATA to be listed as an accredited auditor. FBOs seeking self-certification may submit an employee’s application in order to be considered for the self-certification audit process.
