Senate Approves Bipartisan FAA Reauthorization Legislation, Corporation Not Included

Last Tuesday, the Senate passed H.R. 636, the “Federal Aviation Administration Reauthorization Act of 2016,” bipartisan legislation extending FAA programs and taxes through September 30, 2017. Unlike its House counterpart, the Senate bill does not include provisions to create a user-fee funded air traffic control corporation and instead embraces NATA’s recommendation for incremental change at the FAA that builds on the work begun in the last FAA reauthorization legislation. The bill now moves to the House where lawmakers in that chamber must decide whether to press forward on legislation that includes the creation of a corporation, accept the Senate proposal, or simply extend the FAA’s current authorization beyond its July 15th expiration date. NATA President and CEO Thomas L. Hendricks praised Senate leadership for their work and noted, “we hope this legislation will serve as the impetus for the House to cease efforts to create an air traffic control corporation and instead move ahead with other provisions of the House committee-passed legislation that strongly resemble the bill approved today by the Senate.”


Senate Appropriators Approve FY2017 FAA Budget, Criticize House Plan to Create Air Traffic Control Corporation

On April 21st, the Senate Appropriations Committee approved $16.4b in FAA funding for FY2017, an increase of over $500m above the level requested by the President. Significantly, the Committee was very critical of the House Transportation Committee proposal to establish an air traffic control corporation stating: “The attempt to remove the air traffic control system from the FAA is fraught with risk, could lead to uncontrollable cost increases to consumers and could ultimately harm users and operators in the system including the flying public, the aviation community, FAA’s workforce, and small towns in rural America that rely on access to the national air space. The Committee strongly believes that air traffic control should remain an inherently governmental function where the Air Traffic Control organization is subject to on-going congressional oversight so that resource needs and activities are reviewed. The annual congressional oversight process is best suited to protect consumers and preserve access to urban, suburban and rural communities.” The legislation is expected to be considered by the full Senate within the next few weeks.

NATA Hosts Air Charter Committee Meeting at Headquarters


Last week, NATA’s Air Charter Committee held its spring meeting at the association’s Washington, DC headquarters. At the meeting, the members welcomed Suran Wijayawardana as their new chairman. Wijayawardana is the Chief Operating Officer of Alerion Aviation, an air charter operator based in West Palm Beach, Florida. A busy agenda included a meeting at the FAA with several staff members from the Flight Standards Service, an in-depth review of current FAA reauthorization legislation and discussion of the upcoming NATA Aviation Business Conference. The committee initiated several new projects designed to help the members understand emerging compliance-based issues and also to improve the ability for all NATA air charter members to engage with the committee. New FAA Medical Certification Services Program Available for All Part 135 and 91 Operators


NATA recently launched a new “FAA Medical Certification Services” benefit program for Part 135 and 91 operators and their pilots. Administered by Harvey Watt & Co., this program was previously available only when combined with insurance products or through airlines for their pilots. FAA and EASA Confirm 8130-3 Requirement Extension Regarding MAG Change 5


On April 20th, the Federal Aviation Administration (FAA) and the European Aviation Safety Agency (EASA) issued a letter stating they agreed to extend the deadline provided in MAG CHG 5, Section B Appendix 1, paragraph 10, from April 1, 2016 until October 1, 2016. The letter responds to an industry request, including NATA, for “assistance from the FAA and the EASA regarding compliance with the September 9, 2015 change to the Maintenance Annex Guidance (MAG) which clarifies the requirement that new parts received by a certificated repair station be accompanied by a Federal Aviation Administration (FAA) Form 8130-3, Airworthiness Release Certificate, Airworthiness Approval Tag, issued by a U.S. Production Approval Holder (PAH) when those parts will be installed in articles for which a dual airworthiness release is to be issued.” The letter also notes that both the FAA and the EASA “have agreed that parts released by a PAH prior to October 1, 2016 will not be required to be accompanied by an FAA Form 8130-3. Only parts released from a PAH’s quality system, on or after that date, must be accompanied by the form if intended to be installed on articles subject to the U.S.-EU Aviation Safety Agreement.”


FAA Urges sUAS Owners to Use New Web-Based Aircraft Registration System


Last week, the FAA released a Notice which advises owners of small unmanned aircraft systems (sUAS) “used for purposes other than as model aircraft under the authority of an exemption issued by the FAA” to register their sUAS using the web-based aircraft registration system. The agency announced the system’s availability to these owners on March 30th. The FAA’s press release states, “All owners of small UAS used for purposes other than as model aircraft must currently obtain a Section 333 exemption grant, a certificate of waiver or authorization, or other FAA authorization to operate legally in U.S airspace. Registration is one of the requirements associated with a Section 333 exemption.” The cost to register is $5 per aircraft.


FAA Fly Safe: Prevent Loss of Control Accidents


The FAA and general aviation groups, including NATA, launched a national safety campaign this flying season called #FlySafe to educate the GA community on how to prevent Loss of Control (LOC) accidents. LOC can happen when an aircraft enters a flight regime that is outside its normal flight envelope and may quickly develop into a stall or spin. The 38th annual General Aviation and Part 135 Activity Survey (GA Survey) for reporting on calendar year 2015 is underway! The FAA’s annual GA Survey is the only government source of information on the general aviation fleet, the number of hours flown, and the ways people use general aviation aircraft. The data helps to determine funding for infrastructure and service needs, assess the impact of regulatory changes, and measure aviation safety. If you are selected to complete this year’s survey, you should have received a postcard invitation to participate.
