NATA Member Update: Raise Your Voice on Proposed Air Charter Regulatory Changes

Comment Deadline Approaching on Proposed Air Charter Regulatory Changes

Time is running out to have your voice heard on the FAA’s intent to initiate a rulemaking impacting on-demand charter operators.

NATA, along with other leading aviation associations, has raised concerns about potential unintended consequences of revisions to the regulatory definitions of "on-demand operation," "supplemental operation" and "scheduled operation" under 14 CFR Part 110, which could have ripple effects throughout the entire part 135 and general aviation ecosystem. NATA also recognizes the potential for negative impact on service to small communities, as well as emerging technologies that are poised to further increase the availability, efficiency, and sustainability of on-demand aviation.

In putting forward the notice, FAA officials pointed to the growth in flights conducted under part 380 over the past decade as the basis for the agency’s regulatory review. However, the operational increase has come with no major incidents or accidents under the current regulatory framework, which makes the motive for the FAA’s action unclear.

NATA is collaborating with members from its part 135 community to voice our concerns through the public comment process. We encourage our members to bolster our efforts by submitting their own comments prior to the published deadline of October 13, 2023. Comments may be submitted through the Federal eRulemaking Portal or by other means outlined in the notice
